You are reading this as a participant in that you are registering yourself to participate in Pegasus NYC activities. You do so having the legal authority to enter into such an agreement.

By reading this agreement you agree that you have read and understand the Pegasus NYC Waiver and waive Pegasus NYC from all liability relating to injuries that may occur before, after and during participation of any activity on any location. You agree to hold Pegasus NYC completely free from any and all liability, including but not limited to financial responsibility for injuries incurred, regardless of whether injuries are caused by negligence.

Through registration and participation, you forfeit all right to bring a suit against Pegasus NYC in connection with participation in Pegasus NYC activities. Participants will make every effort to obey safety precautions as listed in writing and as explained verbally. Participants will ask for clarification when needed. Participants and must inform the club and coach of any pre-existing or recent injuries that the player may have prior to participating in any Pegasus NYC activities. If any precautions or medications are need to participate it is the responsibility of the participant to inform, and if necessary, educate the club on how to properly accommodate while participating in club activities. Failure to do so is an assumption of risk and the club shall not be held responsible for any injury no matter how minor or major.

By reading this document, you acknowledge and admit that there are inherent risks involved in the types of activities offered by Pegasus NYC. Therefore the participant accepts full financial responsibility for any injury that may occur either to the participant or to any other participant due to his/her/their negligence. Should the above-mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, you agree to reimburse them for such fees and costs. Participants further agree to indemnify and hold harmless Pegasus NYC, their coach, employees, participants, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from the participant’s negligent or intentional act or omission while participating in activities offered by Pegasus NYC. By reading this document, you agree to have fully read and understand the foregoing assumption of risk, and release of liability and understand that by reading it, it obligates you to indemnify the parties named for any liability for injury or death of any person and damage to property caused by your negligent or intentional act or omission. You understand that by participating in activities with Pegasus NYC, you agree to this form and are waiving valuable legal rights. Participation confirms you have carefully read this Agreement and fully understand its contents.

Participants are aware that this is a release and waiver of liability and read it knowingly, voluntarily, and of your own free will.

 

 

MEDIA RELEASE

By reading this agreement, you grant Pegasus NYC permission to use your photograph, videos, image and likeness in any and all publications for Pegasus NYC. This includes but is not limited to website entries, any form of social media or print publications without payment or any other consideration in perpetuity. You authorize Pegasus NYC to record, edit, alter, copy, exhibit, publish or distribute collectively, use all photos, videos and images. Participation in Pegasus NYC waives the right to inspect or approve the finished product, including written or electronic copy, wherein your photo appears. Additionally, you waive any right to royalties or any form of compensation arising or related to the use of the photograph or video images. You hereby hold harmless and release and forever discharge Pegasus NYC from all claims, demands, and causes of action which you, your heirs, representatives, executors, administrators, or any other persons acting on your behalf or on behalf of your estate which may have or may have by reason of such use of this authorization.
